|10:30 AM||Managing Environmental Liabilities: Creative Uses of Speciality Environmental Insurance Policies to address Past, Present and Future Contamination
Environmental laws are complex and varied, and are often applied strictly, without a need for the showing of intent and typically without a Statute of Limitations. Most states have at least one or two layers of environmental regulation which must neatly roll up under the Federal regulations. No entity is fully exempt from these regulatory burdens - real estate owners, municipalities, manufacturers, power generators and even lenders all have exposure to environmental liabilities - known or hidden.
This panel will explore potential environmental liabilities businesses and minicipalities face, as well as creative solutions that are available from the niche environmental insurance marketplace. This discussion will include a look at some of the specialty policy forms, as well as some success stories and claims examples. We will also take a look to the future and explore some of the current concerns involving emerging contaminants and other threats to financial stability.
